(hereinafter referred to as the “Personal Data Protection Act”) as well as in accordance with applicable European legislation.

From 25/05/2018 inclusive, your personal data is processed in accordance with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons in the processing of personal data and on the free movement of such data, which repeals Directive 95 /46/EC (General Data Protection Regulation = GDPR) and in accordance with Act no. 18/2018 Coll. on the protection of personal data and on the amendment of certain laws in the version valid and effective from 05/25/2018.

What does this mean for you and your personal data in a nutshell and clearly?

Your personal data is any information that concerns you and on the basis of which you are a determinable subject for us as a natural person. This occurs in cases where we can directly or indirectly identify you, in particular on the basis of a generally applicable identifier or other identifier, such as a first name, surname, identification number, location data or online identifier, or on the basis of one or more characteristics or signs, that make up your physical identity, physiological identity, genetic identity, psychological identity, mental identity, economic identity, cultural identity or social identity. It is e.g. identification of your person based on a number, code or one or more elements specific to you. Therefore, personal data includes in particular the contact data of a natural person, his IP address, they can be information about the use of services or about the activities and preferences of a natural person.

So what data do we store?

During your visit to our site, we record the IP address assigned to you by your internet provider, from which pages you visited our site, how long you have been on our site, which specific sub-sites you view, etc. This information is considered personal data, as it is your online identifier, and therefore we handle this data with increased care.

The legal term processing of personal data must be understood as a processing operation or a set of processing operations with personal data or with sets of personal data, in particular their acquisition, recording, arrangement, structuring, storage, change, search, browsing, use, provision by transmission, dissemination or otherwise, rearrangement or combination, restriction, deletion, regardless of whether it is done by automated means or non-automated means.

If you comment on our website, by pressing the add comment button, you agree to the processing of the personal data you provide in the comment (name, surname, e-mail, your page and the content of the comment), while only the name or also the last name (if you enter it) and the content of your comment. We do not use the personal data entered by you for other purposes. You can revoke your consent at any time.

Data retention period

Personal data is stored by the operator for the stated purposes for a period of 5 years, unless special legal regulations (tax, labor law, archiving, accounting regulations) stipulate otherwise or until you withdraw your consent (on the condition that we are not bound by special regulations to archive your data further) . In the time period from the provision of consent until its revocation (or until the objection of the legitimate interest of the operator), the processing of your personal data is legal, even if you revoked your consent after it was granted.

Keeping your personal data safe is of utmost importance to us. We have implemented various security systems to protect data. As technology improves, we also improve these security systems, using virus checks, anti-virus programs and a multi-level firewall. At the same time, persons – employees or intermediaries – who come into contact with your data are properly instructed about the obligation to maintain confidentiality and communication with them takes place via encrypted communication.

In addition, as of 01.07.2018, we have prepared an assessment of the impact on the protection of personal data in accordance with legal regulations in the field of personal data protection and European standards. If by chance our systems are attacked by a hacker attack, or otherwise our system is attacked and there is even a threat of data leakage, you will be informed by our support about the measures taken within 72 hours, and at the same time we will also communicate with the supervisory authority in the area of personal data protection in the Slovak Republic – with the Office for Personal Data Protection.

You have the right to access the data we process about you. If you want to know which specific data we store about you, we will gladly provide it to you in writing upon request.

As a data subject, you have the right to correct the data provided, or supplementing them in the event of any inaccuracies/incompletenesses.

After achieving the purpose of providing personal data – i.e. after providing performance from the consumer contract and ending the use of products via access passwords, you have the “right to be forgotten” = the right to delete the provided data. The right to delete provided personal data also applies if you revoke your consent to the processing of your personal data. In cases where we process your personal data based on your consent, you have the right to withdraw this consent at any time. Withdrawing consent is as easy as giving it: either click the unsubscribe button in the email campaign or write to us at the contact email: marketing@hamsikcorp.com.

In cases where the processing of personal data is based on our legitimate interest, you have the right to object to our legitimate interest. If we consider your objection to be reasonable, we will delete your data processed on the said basis from our systems. We will also delete them if it is proven that the data was processed illegally.

However, the right to delete your personal data is not absolute. If we need your data to fulfill our legal obligations imposed on us by tax laws, accounting regulations and other special legal regulations; for this purpose of fulfilling our legal obligations, we will have to process them further.

As a data subject, you have the right to request the restriction of the processing of your personal data, if you challenge the correctness of the personal data, during the period of verification of the correctness of the data; or if the processing of personal data is illegal and instead of erasing the data, you will request the restriction of its processing; and also if the operator does not need your personal data for the purpose he stated, but you need them for proof, or defending your legal claims (complaints, lawsuits – otherwise the data would be deleted and we would not be able to provide it to you). When restricting the processing of personal data, your data will remain in our systems, but we will no longer use it for our purposes.

At your request, the operator will notify you of a change, correction, or deletion of your personal data. At the same time, you have the right to request the transfer of personal data to the other operator, whose data you notify us in writing. It is technically feasible to transfer the e-mail address, due to the different purposes of their processing (see above), we cannot provide you with machine-readable and transferable data to another operator for technical reasons.

We will handle all your requests in exercising your above-mentioned rights, objection against the legitimate interest of the operator or consent to the processing of personal data within 48 hours of delivery; in the case of a complicated request, no later than 1 month from the delivery of the request.

The operator declares that there is no transfer of personal data to third countries, and your data is stored on servers located in the EU. If by chance there is a transfer to third countries, this is due to the technical operations of our intermediaries, who are major players on the market, and therefore in the intermediary contracts we have concluded with them, the security of your data, as well as the transfer of data outside the EU to the maximum treated as much as possible.

The supervisory authority over the processing of personal data is the Personal Data Protection Office of the Slovak Republic. In the event that we do not respond to your request within 1 month of its delivery, you have the right to contact the Office for the Protection of Personal Data pursuant to section § 100 of Act no. 18/2018 Coll. in valid and effective wording (proceedings on the protection of personal data).

Our team works on the basis of cooperation agreements concluded with the operator. As of 01.07.2018, the mentioned cooperation contracts are supplemented by intermediary contracts, which ensure that your data and those of our team members are safe.
